Refund & Cancellation Policy

The following refund and cancellation terms are also defined in my copywriting agreement, which each client must acknowledge and sign before work is performed.

Termination of Agreement

Either party has the right to terminate the Agreement by providing a written notice to the other party at least 30 days in advance. The Client reserves the right to terminate this Agreement if Chabot Creative fails to rectify any default or breach within ten (10) days of receiving notice from the Client regarding such issues.

Upon termination by either party, Chabot Creative will provide the Client with all copies, whether complete or partial, of the Work Product and any tangible materials or property provided by the Client in connection with the Agreement.

 

Refund Policy

Refunds will not be issued, either in full or in part, for payments made under the Agreement for any reason, including termination. All payments made are considered compensation for services rendered. However, under exceptional circumstances, Chabot Creative may, at its discretion, grant partial or full refunds. Please note that such refunds are not guaranteed.

Force Majeure

Chabot Creative will not be held liable for any delay or failure in fulfilling its obligations under the Agreement if such delay or failure is caused by circumstances beyond its control. Such circumstances may include, but are not limited to, fire, flood, extreme weather conditions, accidents, earthquakes, telecommunications failures, pandemics or epidemics, power outages, network failures, acts of God, terrorism, civil unrest, or labor disputes.

Unforeseeable Circumstances

In the event that Chabot Creative is unable to perform the Services due to sudden illness, incapacity, death, or any other unforeseeable circumstance, Chabot Creative will make every effort to find a suitable replacement service provider (subject to the Client’s approval) to fulfill the Services under the terms of the Agreement. If a suitable replacement cannot be found, Chabot Creative agrees to refund all deposits and payments made by the Client. Acceptance of such refund constitutes a waiver of any further recourse against Chabot for non-performance.
